DIVORCE
The decision to end your marriage can be one of the toughest decisions of your life. Divorce can be contested or uncontested, depending on whether you and your spouse have agreed on all issues unique to your  family. Even if you and your spouse have agreed to the terms of your divorce, it is still wise to ensure you have addressed all possible issues in your case. There are an array of factors that can complicate the process such as:
  • Child(ren) + Child support
  • Custody + Visitation
  • Equitable distribution (Property + Retirement Assets)
  • Spousal maintenance
  • A history of Domestic Violence
  • The existence of debt

In New York, there are several grounds for divorce, which can be found under DRL §170.
Many parties proceed with divorce under DRL §170 (7)- Irretrievable breakdown (no fault divorce), because there is no additional burden of proving fault by a party in order to be granted a divorce. However, in order to be granted a divorce under DRL §170 (7), all issues relevant to the particular case need to be resolved. Most people resolve outstanding issues by stipulation or agreement.

Legally separating from your spouse can be a large undertaking that can have far reaching consequences. The process often places an emotional and mental strain on all parties involved, especially children. It's important to stay informed, have a plan, and focus on what's important to you.

What Clients Are Saying:

"Ms. Chung is a wonderful advocate and a fighter. With her guidance, I was able choose what to fight for in my divorce and what was not important in the long run. There are really no winners in a divorce, but I really did win on so many levels with Ms. Chung as my advocate." - L.U., NY, NY
